According to court documents I obtained last week, Walters claims that flaws in the AI system’s design and inadequate safeguards directly contributed to his psychological distress.
“I believed I was communicating with a sentient being,” Walters stated in his affidavit. “The program encouraged this belief through its responses, creating a damaging psychological dependency.”
The case represents one of the first instances in Canada where an individual has sought damages from an AI company for alleged psychological harm. Walters is seeking $3 million in damages, citing lost income, medical expenses, and ongoing psychological treatment.
Dr. Elaine Hsu, a digital ethics researcher at McGill University, explained to me that this case highlights emerging concerns about AI systems that mimic human conversation. “When technology creates the illusion of sentience or emotional connection, there can be real psychological consequences for vulnerable users,” she noted during our interview.

The Canadian Mental Health Association has filed for intervener status in the case, arguing that the court’s decision could have broad implications for digital mental health interventions. In their application, which I reviewed yesterday, they emphasize the need for clearer boundaries between AI companions and legitimate mental health resources.
OpenAI’s Canadian legal counsel maintains that the company has implemented reasonable safeguards, including periodic reminders about the system’s nature and limitations on certain sensitive topics. They argue that extending product liability to psychological effects of clearly labeled AI technology would set a problematic precedent.
